HomeRundown Terms of Use

These Terms of Use ("Terms") govern your access to and use of HomeRundown, including homerundown.com, its reports, tools, calculations, estimates, software, subscriptions, and related services (collectively, the "Service").

By accessing, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. INFORMATIONAL PURPOSES ONLY

HomeRundown provides automated real estate research, estimates, calculations, and analytical tools for informational and educational purposes only.

HomeRundown does not provide an appraisal, broker price opinion, comparative market analysis prepared by a licensed real estate professional, property inspection, engineering report, environmental assessment, title report, investment recommendation, or financial, legal, accounting, lending, insurance, or tax advice.

Nothing provided through the Service should be interpreted as a recommendation to buy, sell, rent, renovate, finance, refinance, or otherwise invest in any property.

You are solely responsible for your real estate and investment decisions.

2. ESTIMATES ARE NOT GUARANTEED

All values, projections, scores, calculations, and other information generated by HomeRundown are estimates.

This includes, without limitation:

Actual results may differ materially from estimates presented through the Service.

Past property appreciation, rental performance, market activity, or investment performance does not guarantee future results.

3. THIRD-PARTY DATA

HomeRundown may rely on information obtained from third-party providers, public records, property databases, listing information, government records, mapping services, market data providers, user-provided information, and other external sources.

HomeRundown does not control all third-party information and cannot guarantee that such information is accurate, current, complete, or error-free.

Information may be delayed, unavailable, incorrectly reported, incomplete, or outdated.

HomeRundown is not responsible for errors, omissions, or inaccuracies originating from third-party data sources.

4. USER RESPONSIBILITY TO VERIFY INFORMATION

You are solely responsible for independently verifying all information before making any financial, investment, real estate, renovation, rental, financing, or other decision.

HomeRundown should be used as a research tool and should not replace professional due diligence.

Users should verify relevant information with appropriate qualified professionals and authorities, including, where applicable, real estate professionals, appraisers, inspectors, contractors, lenders, insurance professionals, attorneys, accountants, tax professionals, municipalities, zoning departments, building departments, homeowners associations, property managers, and other qualified professionals.

5. PROPERTY PHOTOS AND CONDITION ANALYSIS

HomeRundown may use photographs, listing information, automated systems, artificial intelligence, and other technologies to estimate property condition and potential renovation requirements.

Photographs and automated analysis cannot identify every defect or property condition.

HomeRundown cannot determine from photographs alone whether a property has structural, electrical, plumbing, HVAC, roofing, foundation, environmental, mold, water, pest, code, safety, or other hidden problems.

Any renovation, repair, or condition estimate should be independently verified through appropriate inspections and qualified professionals.

6. RENOVATION ESTIMATES

Renovation and repair costs are estimates only.

Actual costs may vary significantly based on location, labor rates, material costs, contractor availability, property condition, permitting requirements, scope of work, unforeseen conditions, and other factors.

HomeRundown does not guarantee that renovations or repairs can be completed for any amount shown through the Service.

Users should obtain independent estimates from qualified contractors before making purchasing, renovation, or investment decisions.

7. RENTAL AND SHORT-TERM RENTAL ESTIMATES

Long-term and short-term rental projections are estimates and are not guarantees of rental income or occupancy.

Actual performance may vary because of market conditions, seasonality, competition, vacancy, property condition, management quality, economic conditions, regulations, guest demand, operating expenses, platform policies, and other factors.

Short-term rental laws and regulations vary throughout the United States and can change at any time.

You are solely responsible for determining whether a property may legally be operated as a long-term or short-term rental.

Users should independently verify applicable federal, state, county, municipal, zoning, licensing, HOA, condominium, deed, and other requirements or restrictions before purchasing or operating a rental property.

8. RUNDOWN SCORE

The Rundown Score is a proprietary automated analytical estimate designed to help users research and compare properties.

It is not an appraisal, investment recommendation, credit rating, prediction of future performance, or guarantee of profitability.

A high Rundown Score does not mean a property will be profitable, appreciate in value, or perform as projected.

A low Rundown Score does not necessarily mean a property is a poor investment.

The Rundown Score should be considered one research tool among many and should not replace independent professional analysis or due diligence.

9. NO PROFESSIONAL RELATIONSHIP

Use of HomeRundown does not create an attorney-client, accountant-client, financial advisor-client, appraiser-client, broker-client, real estate agency, fiduciary, contractor-client, or other professional relationship between you and HomeRundown.

HomeRundown does not act as your real estate broker, agent, financial advisor, investment advisor, lender, contractor, inspector, attorney, accountant, or tax advisor.

10. NO GUARANTEE OF INVESTMENT PERFORMANCE

Real estate involves financial risk.

Property values may decline. Rental income may decrease. Properties may remain vacant. Renovations may exceed estimates. Financing costs may change. Laws and regulations may change. Unexpected property conditions and expenses may arise.

You may lose some or all of the money invested in a property.

HomeRundown makes no representation, warranty, or guarantee regarding profitability, investment returns, appreciation, rental performance, resale value, renovation costs, occupancy, or future market conditions.

11. USER-PROVIDED ASSUMPTIONS

Some HomeRundown calculations may depend on information or assumptions entered, selected, or modified by users.

Changing assumptions such as purchase price, down payment, interest rate, financing terms, renovation budget, rent, occupancy, expenses, holding period, resale value, or other variables may materially change calculated results.

You are responsible for reviewing the assumptions used in any analysis and determining whether they are reasonable and appropriate for your circumstances.

12. AUTOMATED AND ARTIFICIAL INTELLIGENCE ANALYSIS

HomeRundown may use automated systems, algorithms, artificial intelligence, statistical models, and other technologies to generate or assist in generating reports, estimates, property analyses, scores, comparisons, and other information.

Automated systems can make mistakes.

AI-generated or automatically generated information may misinterpret data, photographs, property characteristics, market conditions, comparable properties, public records, or other information.

You agree not to treat automated outputs as verified facts without independently confirming them.

13. AVAILABILITY AND ACCURACY

HomeRundown attempts to provide useful and reliable information but does not warrant that the Service or any information provided through it will always be available, accurate, complete, current, secure, or error-free.

The Service may contain calculation errors, software errors, data errors, artificial intelligence errors, unavailable information, incorrect assumptions, or other inaccuracies.

HomeRundown may modify, correct, suspend, or discontinue any portion of the Service at any time.

14. PURCHASES AND SUBSCRIPTIONS

HomeRundown may offer individual reports, subscriptions, or other paid services.

A single-report purchase provides access to the individual report or analysis described at checkout.

Subscriptions are billed on a recurring monthly basis unless otherwise stated at checkout.

By purchasing a subscription, you authorize HomeRundown and its payment processors to charge the applicable recurring subscription fee and applicable taxes to your selected payment method until canceled.

Subscriptions automatically renew until canceled.

You may cancel your subscription at any time using the cancellation options provided through your account or Service.

Cancellation prevents future renewal charges but does not automatically provide a refund for charges already incurred, except where required by applicable law or expressly stated otherwise.

Prices, features, report limits, and subscription benefits may change over time. Where required by applicable law, appropriate notice will be provided.

15. REFUNDS

Except where required by applicable law or otherwise expressly stated at checkout, purchases are non-refundable once the purchased report, analysis, subscription access, or digital service has been provided.

Nothing in these Terms limits any non-waivable refund or cancellation rights available under applicable law.

HomeRundown and its software, branding, designs, report formats, scoring methodologies, graphics, text, calculations, and other original content are owned by HomeRundown or its licensors and may be protected by applicable intellectual property laws.

Your purchase or subscription provides a limited right to use the Service for its intended purposes.

It does not transfer ownership of HomeRundown intellectual property to you.

18. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMERUNDOWN AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."

HOMERUNDOWN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HOMERUNDOWN DOES NOT WARRANT OR GUARANTEE THAT ANY ESTIMATE, PROJECTION, CALCULATION, SCORE, COMPARABLE, DATA POINT, PROPERTY ANALYSIS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE OR THAT ACTUAL RESULTS WILL MATCH THE RESULTS PRESENTED.

19. ASSUMPTION OF RISK

By using HomeRundown, you acknowledge that real estate transactions and investments involve significant risks.

You voluntarily assume the risks associated with decisions made using information obtained through the Service.

HomeRundown is intended to assist with research and does not replace your own due diligence.

You remain solely responsible for determining whether to purchase, sell, rent, renovate, finance, or invest in any property.

20. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMERUNDOWN AND ITS OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, DATA PROVIDERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST INVESTMENT VALUE, LOST RENTAL INCOME, LOST OPPORTUNITIES, RENOVATION OVERRUNS, PROPERTY VALUE LOSSES, FINANCING LOSSES, BUSINESS INTERRUPTION, LOSS OF DATA, OR OTHER FINANCIAL OR ECONOMIC LOSSES.

YOU ARE SOLELY RESPONSIBLE FOR DECISIONS MADE USING INFORMATION PROVIDED THROUGH HOMERUNDOWN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMERUNDOWN'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO HOMERUNDOWN DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

(B) $100.

Certain jurisdictions may not permit some exclusions or limitations of liability. In those circumstances, the applicable limitations will apply to the maximum extent permitted by law.

21. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless HomeRundown and its owners, members, officers, directors, employees, contractors, affiliates, licensors, data providers, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from or related to:

HomeRundown may modify, update, add, remove, suspend, or discontinue features, calculations, reports, data sources, scoring methodologies, pricing, or other portions of the Service.

HomeRundown does not guarantee that any particular feature, data source, calculation, or functionality will remain available indefinitely.

23. CHANGES TO THESE TERMS

HomeRundown may update these Terms from time to time.

Updated Terms will be posted with a revised "Last Updated" date.

Where required by applicable law, additional notice or consent may be provided before material changes become effective.

Your continued use of the Service after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

24. APPLICABLE LAW

HomeRundown operates within the United States and is intended primarily for users researching real estate located within the United States.

Your use of the Service is subject to applicable federal, state, and local laws and regulations.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived under applicable law.

25. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible, and the remaining provisions will continue in full force and effect.

26. ENTIRE AGREEMENT

These Terms, together with HomeRundown's Privacy Policy, checkout disclosures, and any other policies expressly incorporated into these Terms, constitute the agreement between you and HomeRundown regarding your use of the Service.

USER ACKNOWLEDGMENT

By accessing or using HomeRundown, you acknowledge and agree that:

HomeRundown does not guarantee the accuracy of property values, rental estimates, renovation estimates, comparable properties, investment returns, Rundown Scores, public records, permit information, flood information, zoning information, or other information provided through the Service.

Real estate investments involve risk and actual results may differ materially from estimates.

You are responsible for independently verifying information and performing your own due diligence.

You should consult qualified professionals and applicable government authorities before making real estate, financial, investment, renovation, or rental decisions.

You remain solely responsible for all decisions you make based on or in connection with information provided through HomeRundown.
